1. Acceptance of Terms

By accessing or using Cutycle ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. We reserve the right to update these terms at any time, and your continued use constitutes acceptance of any changes.

2. Account Registration

To use certain features, you must create an account. You agree to provide accurate and complete information, keep your credentials secure, and notify us immediately of any unauthorized access. You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts that violate these terms.

3. Platform Usage

Cutycle provides tools for nail technicians and their clients, including:

• Online appointment booking with real-time availability.
• AI-powered price quoting from uploaded reference photos.
• Portfolio hosting and management.
• Client management and communication.
• Payment collection and processing.

You agree to use the Platform only for its intended purposes and in compliance with all applicable laws.

4. Payment Processing

Payments on Cutycle are processed through Stripe and Stripe Connect. By using our payment features, you also agree to Stripe's Terms of Service. Cutycle may charge platform fees on transactions processed through the Platform. Fee details are displayed before you confirm any transaction. Refund policies are set by individual nail technicians unless otherwise stated.

5. Content Ownership

You retain ownership of all content you upload to the Platform, including portfolio images and profile information. By uploading content, you grant Cutycle a non-exclusive, worldwide, royalty-free license to display, distribute, and process your content solely for the purpose of operating and improving the Platform. You represent that you have the right to upload all content and that it does not infringe on any third party's rights.

6. AI-Generated Quotes

Price quotes generated by our AI tools are estimates only and are not binding. Nail technicians may adjust final pricing based on actual service requirements. Cutycle does not guarantee the accuracy of AI-generated estimates.

7. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose.
• Upload harmful, offensive, or infringing content.
• Attempt to gain unauthorized access to other accounts or our systems.
• Interfere with or disrupt the Platform's operation.
• Scrape, crawl, or use automated tools to extract data from the Platform.
• Misrepresent your identity or qualifications.
• Use the Platform to send spam or unsolicited messages.

8. Limitation of Liability

To the maximum extent permitted by law, Cutycle and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim shall not exceed the amount you paid to Cutycle in the twelve months preceding the claim. The Platform is provided "as is" and "as available" without warranties of any kind, express or implied.

9. Indemnification

You agree to indemnify and hold harmless Cutycle from any claims, damages, or expenses arising from your use of the Platform, your violation of these terms, or your infringement of any third party's rights.

10. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause and with or without notice. You may close your account at any time through your account settings. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will remain in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Platform shall be resolved in the courts located in Los Angeles County, California.
